The question
I’m a Canadian citizen currently working in the U.S. (Arkansas) in TN status. I have filed Adjustment of Status (I-485) based on marriage to a U.S. citizen (IR-1/AOS), and I also have a pending I-765 (EAD) (I-131 Advance Parole – not filed). My AOS receipt begins with IOE. My priority date is 11/20/2025 and my biometrics were completed on 12/08/2025. My current TN/I-94 expires on 02/13/2026, and I’m concerned my AOS-based EAD may not be approved before my TN expires. I plan to remain in the U.S. and continue working for the same employer in the same role, and HR will likely use immigration counsel. Is it advisable to have my employer file a TN extension of stay via Form I-129 with USCIS while my I-485 is pending, to avoid travel/port-of-entry issues? Would this affect my pending I-485?
