Being part of a workplace investigation can be unsettling, whether you are the subject or a witness. Knowing your rights helps you respond calmly and protect yourself.

What employers can do

Most US employees work 'at will', and employers have broad authority to investigate misconduct, ask questions, and review work accounts. You can be asked to cooperate, and refusing may have consequences.

What protections you have

Employers cannot retaliate against you for reporting discrimination or harassment, or for participating in an investigation into it. In unionized workplaces, you may have the right to have a representative present during questioning.
